Terms And Conditions

Preamble

These Terms and Conditions ("T&Cs") govern every contract concluded between 7Cloud AG, Bahnhofstrasse 19, 9100 Herisau, Switzerland (Commercial Register no. tba, VAT no. CHE‑468.091.118 MWST, hereinafter "Tattup", "we", "us") and any consumer or business customer (collectively "Customer" or "you") via the online store tattup.shop.

1  Scope

1.1 These T&Cs apply to every purchase of goods—especially temporary tattoo sets—offered in our online store.

1.2 Conflicting or deviating terms shall not apply unless expressly accepted by us in writing.

1.3 The version valid at the time of order placement shall prevail.


2  Contractual Partner, Formation of Contract, Minimum Age

2.1 The purchase contract is concluded with 7Cloud AG.

2.2 The product presentation in the shop is a non‑binding online catalogue. By clicking the "Buy" button you submit a binding offer to purchase (Art. 1 Swiss CO / § 145 BGB). The contract is formed once we send you an order confirmation e‑mail or dispatch the goods.

2.3 Orders may only be placed by persons 18 years or older. By placing an order you confirm that you are of legal age.


3  Prices, Shipping Costs, Payment

3.1 Currencies & price lists: We publish fixed price lists in the following currencies (no automatic currency conversion at checkout):

  • Swiss francs (CHF) for deliveries to Switzerland;

  • Euro (EUR) for deliveries to EU Member States;

  • US dollars (USD) for selected international countries (see Shipping Times page). All prices include the applicable VAT; for EU consignments VAT is remitted via the OSS scheme.

3.2 Shipping costs are displayed during checkout. Extra charges may apply for express or special delivery services.

3.3 Accepted payment methods: credit card, PayPal, Apple Pay and Google Pay. Your account will be charged immediately upon contract conclusion.


4  Delivery & Transfer of Risk

4.1 We deliver exclusively to the countries and zones listed on our Shipping Times page (https://tattup.shop/en/pages/shipping-times). Orders outside these regions cannot be accepted.

4.2 The delivery times and charges stated there form part of these T&Cs. The delivery period begins upon receipt of payment.

4.3 If an item is unavailable we will inform you immediately and refund any payments within 14 days.

4.4 Risk of accidental loss passes to you when the parcel is handed over to the carrier. For EU consumers, risk passes only upon physical receipt of the goods (Sec. 446 BGB).


5  Retention of Title

Goods remain our property until paid in full (Sec. 449 BGB / Art. 214 Swiss CO).


6  Right of Withdrawal for EU Consumers

6.1 Withdrawal period: You have the right to withdraw from the contract within 14 days without giving any reason. The period begins on the day you receive the goods.

6.2 Exception for sealed hygiene goods: Our tattoo sets are delivered in sealed packaging with a tear strip. Once this strip has been opened, your right of withdrawal expires (Art. 16 (e) Consumer Rights Directive 2011/83/EU / Sec. 312g (2) No. 3 BGB) because the tattoos then become directly accessible and—out of environmental consideration—are not additionally wrapped.

6.3 Effects of withdrawal: If you withdraw, we will reimburse all payments received from you, including the cost of the least‑expensive standard delivery, without undue delay and at the latest within 14 days from the day we receive the return. We will use the same payment method you used for the initial transaction.

6.4 Return costs: You bear the direct cost of returning the goods if we informed you of this obligation in advance (Sec. 357 (2) BGB).

6.5 How to withdraw: Within the 14‑day period, send an e‑mail to help@tattup.shop and attach at least one photo of the unopened packaging or products. A model withdrawal form is enclosed with every order confirmation and available for download online.


7  Voluntary Return & Goodwill Policy

7.1 Without prejudice to statutory rights, we accept returns of unopened, sealed products within 14 days of delivery for a refund of the purchase price.

7.2 Opened products cannot be returned for hygiene and safety reasons. In exceptional cases, we may offer store credit or a replacement at our discretion; no legal entitlement exists.

7.3 E‑gift cards, sale items, tattoo bundles and limited editions are excluded from returns and refunds.


8  Warranty

Statutory warranty rights apply (EU: Secs. 434 ff. BGB; CH: Arts. 197 ff. Swiss CO).


9  Liability

9.1 We are liable for slight negligence only if essential contractual duties are breached; liability is limited to the typical, foreseeable loss.

9.2 Liability for indirect damage, lost profit and data loss is excluded where legally permissible.

9.3 Nothing in these T&Cs excludes liability under product‑liability law or for injury to life, body or health.


10  Health & Application Notice

10.1 Our inks are registered within the EU Cosmetic Product Notification Portal and comply with all EU safety requirements.

10.2 Products are not suitable for persons under 18 years. We recommend performing a patch test on a small area of skin before first use.

10.3 If you have known allergies to any ingredients, do not use the products. We assume no liability for individual reactions if our labelling obligations have been fulfilled.


11  Customer Account & Store Use

11.1 You must keep login credentials confidential and not share them with third parties.

11.2 It is prohibited to use the store for illegal activities, spam, automated crawling or to infringe third‑party rights.


12  Intellectual Property

All content on tattup.shop (texts, images, graphics, trademarks, logos, designs) is protected by intellectual‑property law. Any use requires our prior written consent.


13  EU Responsible Person (Cosmetics Regulation)

See details in the Preamble. The Responsible Person maintains the Product Information File and acts as primary contact for European authorities.


14  Privacy

Personal data is processed exclusively in accordance with our separate Privacy Policy, available at https://tattup.shop/en/pages/privacy-policy.


15  Changes to the T&Cs

We may amend these T&Cs at any time with effect for future orders. The current version is published in the shop. Contracts already concluded remain governed by the version valid at the time of purchase.


16  Applicable Law & Jurisdiction

16.1 Swiss substantive law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

16.2 For EU consumers, mandatory consumer‑protection provisions of the country of residence remain unaffected.

16.3 The exclusive place of jurisdiction for disputes with business customers is Herisau, Switzerland.


17  Online Dispute Resolution (ODR)

The EU Commission provides an ODR platform at https://ec.europa.eu/consumers/odr/. We are neither willing nor obliged to participate in dispute resolution procedures before a consumer arbitration board.


18  Severability

Should any provision of these T&Cs be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by the statutory rule.
